XOEye Technologies, Inc. (“XOi”, “we”, “us” or “our”) is committed to protecting the privacy and security of your personal information. This Applicant  Privacy Notice (“Notice”) describes what information we collect from job applicants in connection with their  application of employment, internship or fellowship with XOi (each, an “Applicant” or “you”), why we collect  and use it, and Applicants’ rights with respect to this information. This Notice applies whether you apply online through the Careers page on the XOi website (“Website”), through a third-party job board, by email or in person. 

Please note this Notice is not intended to constitute any offer of employment, internship, or fellowship by XOi. In addition, your activities on our Website will also be governed by our Privacy Policy

This Notice was last updated May 18, 2026.

We may update or modify XOi Applicant Privacy Notice at any time, by posting the amended version including the effective date of the updated version. You are responsible for periodically visiting the Website and viewing this Notice to check for any changes.

2. The information we collect about you 

We may collect, store and process different types of information about Applicants in connection with their  application, and more specifically prior to hiring and the start of employment, in accordance with applicable law(s),  as detailed below in this Notice, and as applicable. 

  • Personal identification details: First name, last name, email address, contact number, mailing address, and your LinkedIn or other online profile URL; 
  • Information contained in your job application, cover letter and/or resume: Employment history, educational background, professional qualifications, language and other relevant skills, certification details, willingness to relocate,  and any additional information you provide us with; 
  • Job preferences: Information related to your job preferences, such as desired salary, interest in obtaining employment visa sponsorship or willingness to relocate; 
  • Interview correspondence and communication: This may include notes linked to your interview(s), email exchanges and telephonic communications related to your interview(s), and job proposals that may have  arisen between you and our recruitment team;  
  • Data resulting from skills assessments: Information related to any assessments, including  knowledge/aptitude/skill tests and take-home assignments you may take as part of the interview or  application process. This information is only collected if, after an initial analysis, your resume is considered suitable for the position and is used to assess your suitability for the applied role. These tests will always form an objective thread in the selection process and will always go hand in hand with a professional  assessment and in-depth analysis by our recruitment team;  
  • Sensitive/special category personal information: The nature of sensitive or special category personal  information may vary from one jurisdiction to another. As a general rule, we try not to collect or process  any sensitive personal information about you, unless authorized by law or where necessary to comply with  applicable laws. However, in some circumstances, we may need to collect, or request on a voluntary  disclosure basis, some sensitive personal information for legitimate employment-related purposes and to  the extent required or legally permissible for the purposes of equal opportunities (on the basis that it is in  the public interest and in accordance with applicable law), monitoring, to comply with anti-discrimination  laws, government reporting obligations; or to provide work-related accommodations. This may include  attributes such as gender, race/ethnicity, veteran status, disability status, work authorization status, security clearance, union membership, information about your physical or mental condition (that you may provide  as part of an accommodation request), or criminal convictions data. XOi is committed to an equal  employment opportunity. To that end, any sensitive/special category personal information collected for  the purposes mentioned above will never be used for discrimination against any Applicant during the  selection process; 
  • Information from third-parties: Information provided to us about you from third parties, including from  your references, recruitment agencies and sites, and XOi employees who referred you, have worked  with you or otherwise know you. Applicants may be subject to the completion of certain background checks which are permitted or required by applicable employment laws. We may conduct background checks using a third-party provider, but will request your consent to do so, in which case, the background checks may involve the collection of additional personal information about the Applicant (including date of birth and Social Security Number (SSN)) and other data from educational institutions, government agencies, previous  employers, credit reporting agencies (where permitted by local law), information in the public domain, and  law enforcement agencies at the international, national, or local level so far as is permitted by applicable  law.  If an Applicant’s prior employers and/or other references are contacted, the report may include  information obtained through personal interviews.  
  • Recordings: CCTV footage from attendance at any XOi sites where we control the CCTV systems and any recordings of online video meetings, interviews or assessments; and
  • Information collected through cookies and similar technologies: Information received from your use of the Website including but not limited to your IP address, device/browser information, the pages you view, the functions/features that you use, the buttons and icons you click, the resources you access and the files you download.

Please note that the type of personal information we collect about you will depend to some extent on your  circumstances, the role you are applying for and our legal obligations.  

With respect to your personal information subject to this Notice, XOi is a covered business (or similar under the applicable US-state  privacy laws) or the data controller (under the EU and UK General Data Protection Regulation (GDPR)), and is responsible for how your personal information is processed.  

Sources of personal information collection

We collect your personal information from the following sources: 

  • Directly from you, when you share your information with us during discussions or communications, or when your job application on the Website; 
  • Third-party websites, professional social networks, employment agencies and recruitment partners, that you have used to apply for a job position at XOi; 
  • Current XOi employees or contractors, as part of our internal referral program
  • Previous employers and former managers, in the form of employment references; and
  • Background check providers, as part of the recruitment process, who may further collect your information from other sources such as your previous employers, accreditation boards, etc.

3. How we may use your information 

We will use the personal information collected above to carry out our recruitment and hiring processes. Most  commonly, our purposes for collecting and using your personal information include: 

  • to comply with a legal obligation on us (including, in respect of sensitive/special category personal  information) in relation to government reporting, anti-discrimination laws, employment/labor laws,  monitor globally our progress in promoting equal opportunities and compliance with equal opportunities legislation, and to review or report on federal contractor compliance (e.g., the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA));  
  • for our own legitimate interests (or those of a third party) where these are not overridden by your interests and fundamental rights. For example, XOi has a legitimate interest in: 
    • the processing of applications for employment, internships and fellowships; 
    • assessing your provided documents and therein contained personal information to ensure that  your skills and experiences match to the skills and experience provided on the job posting. This  does not form an automatic decision making and solely supports our recruiting personnel in the  recruiting process. All decisions affecting your application are conducted by individuals responsible  for such processes; 
    • managing our relationship and communicating with you about your application, including  scheduling interviews and messaging via email; 
    • the appropriate vetting for recruitment, where relevant and appropriate background checks, right to  work verification, identity fraud checks, relevant employment history, relevant regulatory status and professional qualifications; 
    • administering diversity, equality and inclusion initiatives; 
    • protecting XOi’s interests, including maintaining the security and integrity of our facilities  and electronic platform, protecting our legal rights and obligations, and for any purposes in  connection with any legal claims made by, against or otherwise involving you;  
    • keeping you in mind for future opportunities at XOi; 
    • processing of personal information for internal business purposes, including to design efficient and workable business processes, to allow cross-company teams to work together and to make  business processes more efficient and cost effective; and 
  • to comply with lawful requests by public authorities (including without limitation to meet national security or law enforcement requirements), discovery requests, or where otherwise required or permitted by  applicable laws, court orders, government regulations, or regulatory authorities (including without  limitation data protection, tax and employment), whether within or outside your jurisdiction.

There may be more than one purpose that justifies our use of your personal information in any particular  circumstance. In some cases, background check reports obtained through our third-party screening provider may not contain complete or sufficient information. Where this occurs, we may make employment-related decisions based on the information available to us, taking into account the nature of the role and other relevant factors, in accordance with applicable law.

If you are from a jurisdiction that requires a legal basis for processing personal information, such as the European Economic Areas (EEA), United Kingdom (UK) or Switzerland, XOi’s legal basis will depend on the personal information concerned and the context in which we collect it. We will normally only use your personal information where we reasonably consider it necessary for complying with a legal or regulatory obligation, in anticipation of entering into a contract of employment with you, or for our legitimate interests to recruit the best possible  applicants. If we need to use your personal information for an unrelated purpose, we will notify you and explain the purposes and/or legal basis which allows us to do so (where we are required to do so under applicable data protection laws). 

In most instances, you are required to make your personal information available (such as part of your job application and screening), and the supply of the information is accordingly mandatory. In instances where it is voluntary, we  will inform you accordingly. If you fail to provide certain personal information when requested, the affected  application processes or provision of the job application portal might be delayed or affected; and in some cases, we may not be able to proceed with your application. 

Use of Artificial Intelligence (AI) technologies in the recruitment processes

As part of XOi’s recruitment and Applicant evaluation process, we may use AI-powered technologies. Some (non-exhaustive) examples of recruitment tasks that XOi may use AI for include conducting initial screening, creating transcripts of interviews, assessing applications/CVs against defined job description criteria to make suggestions to the individuals evaluating your candidacy and performing AI-based online tests or assessments.

Information collected via AI technologies is not shared with third parties for unrelated purposes and may only be accessed by HR personnel, hiring managers, or technical staff responsible for administering the recruitment processes.

The data from such AI use is used solely to create efficiencies during the recruitment process and support decision-making. We confirm that AI will not take any automatic decisions regarding your application and human recruiters and hiring managers will ultimately take a decision regarding your candidacy. 

4. Who we may share your information with

We may be required to process your personal information in connection with your recruitment and selection, both internally and externally. In principle, your personal information will only be transferred to the recipients responsible for the various processing operations for the above-mentioned purposes on a need-to-know basis. We will not otherwise sell your data that you provide to us in connection with the application process. We may share your personal information as described below:

Subsidiaries, Contractors, and Affiliates

We may disclose personal information that we collect from or  about you with our subsidiaries, contractors, and affiliates.

Service providers

We use a number of trusted service providers to perform certain recruitment-related  functions for us or carry out the uses of personal information described above. This includes companies that we engage with for managing and optimizing our hiring or recruitment process, including the tools and systems we use for this purpose, such as our applicant tracking system, administration and analysis of our technical assessments, conducting background checks and other vetting/assessment processes, and supporting us in scheduling interviews for recruitment. When engaging with such service providers, we always set up a formal agreement with them that imposes appropriate data protection provisions commensurate with the sensitivity of information shared to protect and safeguard your information.

Professional advisors

We may share your personal information to seek advice, as required, from  professional advisors such as accountants, auditors, lawyers, insurers, and tax advisors.

Parties to a corporate transaction or proceeding

We may also share your personal information in  connection with any proposed or actual reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

Legal requirements

We may share personal information with third parties in order to: (a) comply with a  legal process or a regulatory investigation (e.g., a subpoena or court order); (b) enforce this Notice, or other  contracts with our business partners, including investigation of potential violations thereof; and/or (d)  protect us, and our affiliates against injury, theft, legal liability, fraud or abuse. We likewise may provide information to other companies and organizations for detecting security incidents, debugging, internal  research, and similar purposes.

Public and governmental authorities

We may share personal information with entities that regulate or  have jurisdiction over us such as regulatory authorities, public bodies, and judicial bodies, including to meet  national security or law enforcement requirements (including around immigration).

Application for further positions 

Occasionally, we may also have an interest in and need for competent applicants in other areas and would be happy to consider your application for other vacancies. With your application, you agree that other recruiters from XOi may also view your application data, and take it into account when filling vacancies. 

Should you appear to be suitable for the vacancy, we would approach you to inquire whether you would be  interested in participating in the selection process for the position to be filled. 

5. Your rights and options regarding your personal information 

Depending upon your jurisdiction, you have certain rights under applicable data protection laws, as detailed in the XOi Privacy Policy. If you would like to exercise your rights over the personal information we have collected about you, you may reach out to us at the details noted under ‘How to contact us’ section above. 

We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.

Recruitment Campaigns

You can opt out of receiving information about our recruitment campaigns from XOi. You may unsubscribe from these emails at any time by a) unsubscribing using our website, b) logging into your online profile, if you have one, or b) by clicking the unsubscribe link on any recruitment campaign email from us.

We will take reasonable steps to unsubscribe you from these emails, but it may take up to 72 hours to take effect.

6. How we safeguard your personal information 

XOi employs reasonable and appropriate technical and organizational measures to protect personal  information that are consistent with applicable privacy and data security laws and regulations, including the  implementation of access control, encryption, detection and monitoring technologies, and contractually requiring  service providers to use appropriate measures to protect personal information. These measures vary based on the  sensitivity of the personal information we collect, process, and store, and the current state of technology. 

In addition, in accordance with XOi’s Employment Covenants Agreement, Acceptable Use Policy, and related security and privacy training, our staff has a responsibility to protect data they have access to.  

7. How long we store your personal information 

Our retention periods for personal information are based on business needs and local legal requirements. We retain personal information for as long as is necessary for the processing purpose(s) for which the information was collected, as set out in this Notice, and any other permissible, related purposes.  

If you apply for a role at XOi and we decide not to move forward at this time, we may retain your information for a period after your application is submitted for business and legal purposes, including keeping you in mind for future employment opportunities at XOi, to improve our recruitment and application processes, for the purposes of defending ourselves against a legal challenge related to a recruitment decision, or to comply with  XOi’s legal obligations. The retention periods vary depending on your location and local legal requirements. 

If you are hired by XOi, we generally retain your personal information for the period of your employment or  contract with us, and thereafter as required by the law of the country you are employed in, or in accordance with  our internal retention policies.  

8. Special notice to non-U.S. users regarding data transfers

We store your personal information in the United States or other locations outside your home country. By using XOi’s career page on the Website or otherwise applying for work with us, your personal information may be transferred to countries outside the country in which you reside, which may include countries with a different data protection regime than in place in the country in which you reside.  We will take appropriate technical, organizational, and legal steps to secure personal information about you.

9. Your obligations 

You should keep your personal information up to date and inform us of any significant changes to your personal  information.  

10. Your consent

By proceeding with your application, where required by applicable law, you indicate your acceptance of our collection, use, transfer and disclosure of personal information as described in this Applicant Privacy Notice. If you do not accept the terms, you may not apply for a position at XOi.  The provision of personal information is voluntary. Please note however, failure to provide sufficient information may result in XOi being unable to consider your application.
